July 28, 2008 - UPDATE

Barbara Ann Pool Sentenced by Superior Court Judge Jo Lynn Lee

Barbara Pool was sentenced this morning in Hayward Superior Court by Judge Lee. Judge Lee handed down a sentence of 10 days in jail. Ms. Pool was put on 3 years probation and received an order allowing the Police to stop and inspect Ms. Pool’s vehicle and person anytime day or night. She was ordered to pay restitution to Rev. Deacon Dave Rezendes for damage to the Camera. Pool was ordered to dispose of all Spray Cans of Paint at her home. It was further stated by the Judge that if she is found possessing or in the possession of Spray Paint she would be arrested and sent to jail.

Judge Lee issued an extensive Restraining Order against Ms. Pool for the Safety and freedom of Deacon Dave. She was ordered to Stay 200 yards from: Deacon Dave’s residence, the House of the Dove. Deacon’s Mother’s Residence. St. Michael Church Complex composed of the Church, Rectory, Convent, Hall, School, St.Vincent DePaul Food Distribution Center and parking lots. Cathedral of Christ the Light Complex composed of the Chancery, Cathedral, Gift Shop, Cafeteria, Clinic and Offices. Security Eye Patrol, Inc. Office in Livermore, and the Security Eye Office at the Alameda County Fair Grounds.

Judge Lee also ordered that Pool is not to contact any of the above thru telephone, Electronic means, Mail or third parties.

Pool was further ordered to perform community service approved by the court and not anything service attached to the church. Pool received additional court fees and fines. Ms. Pool was ordered to contact a court office to arrange payment.

Pool had several outburst one of which she stated” Diocese of Oakland Attorney Paul Cesari of San Francisco said that Rezendes can not have anything to do with St. Michael School and is not to be there” The Judge ordered Pool to silence. Later Deacon Dave said NO such order exists. Deacon Dave received an Honor in June 2008 from The Department of Elementary Schools National Catholic Educational Association. Deacon Dave has long been a supporter of St. Michael School and Catholic Education.

The Court was not happy to learn that Pool telephoned the New Pastor of St. Michael Parish on Saturday. The Dep. D.A. stated that this was in violation of the Judges order to stay away from Deacon Dave. He reminded the Court that leading up to the trial there was a Restraining Order to Stay away from St. Michael Church and not contact them. Pool stated to the Judge that Father Robert replaced Father Sacca who they got rid of. (Father Sacca was promoted to Vicar of Clergy. The people of St. Michael Parish were sorry to see leave the Parish. )

Pool wanted Fr. Robert to write a letter to the Court in behalf of Pool. She said that “Rezendes” does not go to all the Masses so she should be able to go to some.” Fr. Robert Said “that Pool needs to get on with her life and go to St. Charles Catholic Church in Livermore or St. Augustine in Pleasanton.” Pools said that Fr. Robert said that she would not be safe at St. Charles because of a conspiracy and rape” Needless to say the Judge ordered Pool to silence. (upon checking at a later time, Father Robert did not say that there was a conspiracy involving rape. The priest said that Pool is the one who brought that up.

It was learned that Pool has brought charges against a Bailiff of Dept. 158. The Deputy Sheriff (Bailiff) was assigned to the Court Room. It was mentioned that on the last day of testimony before the Jury was given the case. A Livermore Police Officer testified regarding his Police Report involving the Vandalism on October 28, 2005 at Deacon Dave’s Residence (House of the Dove.) Apparently Pool became very vocal against the Police Officer.

Judge Lee stated that this was taking longer that it should have for the Sentencing.

Pool vs. Catholic Church, Oakland Diocese Barbara Pool loses another one

Judge John Appel of the Oakland Superior Court has dismissed Pools action against the remaining defendants, Bishop Vigneron, Sister Flannery and Father Silva. This now disposes of this action as to all defendants. Deacon Dave was dismissed several months ago from the suit. Pool brought suit against the Roman Catholic Church because they did not Terminate Deacon Dave from his position as the Bishop’s Representative and Director of Deacon Personnel and as a cleric assigned to St. Michael Parish.
